I reviewed your most recent
submittal and I plan to approve it as submitted except for section
1.4(35).
(35) Pass
Through. A discharge which exits the POTW into waters of the State in quantities or
concentrations which, alone or in conjunction with a discharge or discharges
from other sources, is a cause of violation of any requirement of the City’s
NPDES permit (including an increase in the magnitude or duration of a
violation).
The City included the definition of “Waters of the State” in
section 1.4 (59); therefore, I assume that changing “Waters of the United
States” to “waters of the State” was an oversight and I made the
change.
